Terms of Service

1. Acceptance of Terms

By accessing or using Headless HQ ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree, do not use the Service.

2. Account Terms

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must be at least 18 years old to use the Service
• One person or organization may not maintain more than one free account

3. Acceptable Use

You agree not to:

• Use the Service to violate any applicable law or regulation
• Use AI agents to generate deceptive, misleading, or fraudulent advertising content
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to send spam or unsolicited communications
• Exceed reasonable usage limits or abuse API rate limits

4. AI Agent Actions & Approval

Headless HQ uses AI agents to perform actions on your behalf, including campaign creation, budget allocation, and creative generation. You acknowledge that AI-generated content and recommendations may not always be accurate. You are ultimately responsible for reviewing and approving all agent-proposed actions before they are executed. The approval workflow is designed to give you full control — nothing goes live without your explicit consent.

5. Intellectual Property

You retain ownership of all content, data, and creative assets you upload or create through the Service. Headless HQ retains ownership of the platform, its software, design, and branding. AI-generated creative assets (text, images, videos) produced through the Service are owned by you, subject to the terms of the underlying AI providers (OpenAI, etc.).

6. Third-Party Platforms

The Service integrates with third-party advertising platforms (Meta, Google, TikTok). Your use of those platforms is governed by their respective terms of service. Headless HQ is not responsible for changes, outages, or policy enforcement by third-party platforms that may affect your campaigns.

7. Limitation of Liability

To the maximum extent permitted by law, Headless HQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim. The Service is provided "as is" without warranties of any kind, express or implied.

8. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases immediately. We may suspend or terminate your account if you violate these terms. We will make reasonable efforts to provide notice before termination, except in cases of egregious violations.

9. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
